Terms of Service

Acceptance of Terms

By creating an account or using Packt (“the Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.

The Service

Packt is a collaborative vacation planning platform. We provide tools for group chat, itinerary planning, expense tracking, photo sharing, location mapping, and information pinning. The Service is provided on an “as is” and “as available” basis. Some features of the Service are available free of charge, while others require a paid subscription or one-time purchase (such as Packt Pro or Trip Pass). These Terms apply to all use of the Service, whether free or paid.

Your Account

• You must provide accurate information when creating your account
• You are responsible for maintaining the security of your account
• You must be at least 13 years old to use Packt
• One person per account. Shared accounts are not permitted

User Content

You retain ownership of content you create on Packt (messages, photos, itinerary data, expenses, pins, and other materials). You are solely responsible for all content you upload to or create within the Service.

By uploading content, you grant Packt a worldwide, non-exclusive, royalty-free license to store, display, reproduce, and transmit that content to other group members as part of the Service. If you choose to publish a trip or make content publicly available, you additionally grant Packt the right to publicly display, reproduce, and sublicense that content for the purpose of operating the publishing and cloning features.

You are responsible for maintaining your own copies and backups of all content you upload to Packt. Packt has no obligation to store, maintain, back up, or return your content. Packt may remove or delete content at any time, including upon account termination, policy violation, or discontinuation of the Service.

You agree not to upload content that:

• Violates any laws or regulations
• Infringes on intellectual property rights
• Contains malware or harmful code
• Is abusive, harassing, or threatening

Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service's infrastructure
• Scrape, crawl, or collect data from the Service without permission
• Impersonate another user or person

No Warranty on Data

Packt does not warrant or guarantee the integrity, accuracy, availability, or persistence of any data stored through the Service. Your data may be lost, corrupted, or become temporarily or permanently unavailable due to technical failures, software errors, infrastructure outages, actions by third-party sub-processors, service updates, or other causes beyond our reasonable control.

The Service relies on third-party infrastructure providers, including but not limited to Convex (database and storage), Clerk (authentication), and Vercel (hosting). These providers operate independently, and Packt does not guarantee their uptime, reliability, or data preservation. Packt is not liable for any loss, corruption, or unavailability of data caused by the actions or failures of these third-party providers.

Packt does not provide guaranteed backups or data recovery services. You are solely responsible for maintaining your own copies of any content or information that is important to you.

Service Availability

Packt does not guarantee any specific level of uptime or availability. The Service may be modified, updated, interrupted, suspended, or discontinued at any time, with or without notice, for any reason. Packt is not liable for any modification, suspension, or discontinuation of the Service or any part thereof.

Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time by contacting us. Upon deletion, your personal data will be removed, though group content you contributed may remain visible to other group members.

Limitation of Liability

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, uninterrupted availability, data accuracy, and data preservation.

To the maximum extent permitted by Austrian law, Packt, its operators, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to:

• Loss of data, data corruption, or inability to access data
• Missed, disrupted, or altered travel arrangements
• Financial disputes or losses between group members
• Service interruptions, downtime, or unavailability
• Failures of third-party sub-processors or infrastructure providers
• Unauthorized access to or alteration of your data, despite reasonable security measures being in place
• Loss of revenue, profits, or anticipated savings

Liability for slight negligence is excluded, except in cases of personal injury. Liability for gross negligence, willful misconduct, and personal injury remains unaffected and cannot be excluded or limited under these terms.

Mandatory consumer-protection rights under the Austrian Consumer Protection Act (KSchG), the Austrian Civil Code (ABGB), and applicable EU consumer protection directives remain fully unaffected. Nothing in these terms limits or excludes any liability that cannot be lawfully limited or excluded.

Where paid features of the Service are concerned (such as Packt Pro or Trip Pass), additional warranty obligations may apply under the Austrian Consumer Guarantees Act (VGG) for digital services provided against payment.

Indemnification

You agree to indemnify, defend, and hold harmless Packt and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) content you upload that violates applicable laws or infringes third-party rights, or (b) your use of the Service in violation of these terms. This indemnification obligation does not apply to the extent that the claim results from Packt's own gross negligence or willful misconduct.

Governing Law

These Terms of Service and any dispute arising out of or in connection with them are governed by the laws of the Republic of Austria, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer resident in another EU member state, mandatory consumer protection provisions of your country of residence remain unaffected.

Jurisdiction

The exclusive place of jurisdiction for all disputes arising from these terms is the competent court in Vienna, Austria. For consumers, the place of jurisdiction is determined by §14 of the Austrian Consumer Protection Act (KSchG).

Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute-resolution proceedings before a consumer arbitration board.

Changes to Terms

We may update these terms from time to time. We will notify users of significant changes via email. Continued use of the Service after changes constitutes acceptance of the new terms.
